Agreement between you and EduPros Inc.
PLEASE READ AND TAKE THE TIME TO UNDERSTAND THE TERMS AND CONDITIONS OF
SERVICE. BY USING THIS WEBSITE YOU WILL BE BOUND BY THE TERMS OF THIS
AGREEMENT IN THEIR ENTIRETY.
The Terms of Service can be updated at any time; therefore, you may review any
changes to the terms of service from the menu or at the following link:
http://www.edupros.com/main/Terms.aspx.
YOU MUST BE 18 YEARS OLD TO USE THIS SITE AND LEGALLY ACCEPT THIS AGREEMENT.
IF YOU ARE UNDER 18 YEARS OF AGE, YOUR PARENTS MUST AGREE TO THE TERMS OF
SERVICE BEFORE YOUR USE OF THE WEBSITE.
EduPros Website
The "Service" as it is referred to in this document includes but is not limited
to any use of EduPros Inc. owned or operated websites, Research Caddy program,
shopping cart, and the EduPros website.
The EduPros Research Caddy service is a web based facilitator or tool for
conducting surveys for educational research.
Modifications
In our mission to strive for excellence in Educational Software, EduPros Inc.
can and will update the EduPros Website at any time. For example but not
limited to, changes resulting in improvement to the program. EduPros Inc. will
do its best not to interrupt the service but on occasions it may be deemed
necessary. We will do our best to minimize any inconveniences. EduPros reserves
the right to change or discontinue any part or product temporarily or
permanently at any time. Furthermore, EduPros Inc. reserves the right to add
limitations if necessary to balance and control the usage of the website so
that all users have the same opportunity for its service. EduPros Inc. reserves
the right to discontinue any account in violation of the Terms of Service
without refund. Additionally, EduPros Inc. may discontinue any account not in
violation of the Terms of Service, with proper refund of the prorated time
remaining (any part of a month constitutes the full month completed).
Your Obligations - Conduct
Your EduPros Research Caddy account is a private research account and is
limited to your individual use. Additional warning: It is directly linked to
your shopping cart account (password re-entry required). All surveys
must be directly linked to your own research. One condition that may trigger an
audit of your account may include but is not limited to: a large number of
surveys in a relatively short period of time, for example, 5 different surveys
in one month. Violations will result in charges for an additional 1 year
account at the current rate.
Any foul play in the EduPros Website program should be reported to
CustomerService@EduPros.com
immediately. Foul play may include but is not limited to:
spam, sexual material, misuse of email attachments (designed specifically for
attaching a cover letter by a college or university to be used as a letter of
authenticity, any use outside educational research, multiple individuals using
a single account, and access of accounts other than your own. Violations of any
Term of Service will result in a minimum of $100.00 fine and immediate
termination of the account in violation without refund.
Demo accounts are bound to the same terms of service as paid subscribers. Demo
accounts do have limitations and will expand to full user accounts upon
purchase. You must obtain an education institution email address to use the
EduPros Research Caddy. We recognize that not all schools have addresses
containing ".edu". If you are from a legitimate school performing educational
research, contact EduPros at

Limitations on Sexual Content Research
EduPros is aware that some research will contain sexual content. Before you
send any such survey, email

for approval to avoid any legal issues. EduPros does
not wish to be associated with sexual content and may require additional
wording to be added to your survey and/or email letter. This Violation will
result in: a minimum $100 fine per instance, including but not limited to, each
individual email recipient; immediate termination of your account without
refund; and legal prosecution to the fullest extent allowed by United States
Federal and California State Law. This can be avoided by simply emailing
CustomerService@EduPros.com
before sending.
Non-Commercial - Non-Advertising - Use Limitation
Due to the nature of the program, EduPros Research Caddy utilizes a form of
bulk email in soliciting response for your surveys. You have the ability to
modify the email sent, therefore take the responsibility to abide by
educational standards. You may only include links in emails that point directly
back to your sponsoring college or university. Please note the sexual content
warning above.
EduPros Research Caddy is not a resale site. Therefore, your account is not
transferable, reassign-able or refundable for unused time. This site is for
Educational Research only. You may not use your account for marketing purposes.
Violations will result in a minimum of $100.00 fine per email sent, termination
of your account without refund and further legal action if necessary pending
the type and amount of violations.
You agree to not reproduce, reverse engineer, duplicate, copy, sell, trade,
resell, or exploit for any purposes including commercial, any portion of the
service (EduPros web site and Research Caddy Program), use of the service, or
access to the service.
Passwords and Security
EduPros uses SSL encryption in all credit card transactions. Furthermore,
EduPros does not store complete credit card numbers (only the last four digits
as a reminder of which card was used).
Your password should be kept private. Any violations performed from your
account are your responsibility. Any use from your account that is not yours
should be reported to

as soon as possible in order to avoid violations.
International Limitations
EduPros Website is designed for usage only in the United States of America
and does not hold any guarantees or warranties outside the United States of
America. Questions or the possibility of approval should be sent to
CustomerService@EduPros.com.
For Legal Responsible Use Only
All use of the EduPros Website site must follow all Federal, State, and
Local laws governing its use. Take special consideration and seek legal advice
when dealing with surveys involving minors (children under age 18). All surveys
should pass through an approval board at your college or university. By
creating a survey, you assume full responsibility for the content of your
surveys, emails and results.
Feedback and Requests
Providing feedback or a request is only for internal use towards possible
enhancement to the program, it does not constitute any agreement or contract
for changes. EduPros will strive for excellence that incorporates the best
interest of all users.
Backup and Restore
EduPros Inc., the developer and owner of Research Caddy, is not responsible for
lost data. It is your responsibility to keep your data backed up regularly.
EduPros Inc. recommends backing up your account before and after any major
changes (create a new survey, letter, email, send a survey, or receiving your
results), as well as daily backups. It is also recommended to increase the
number of times you backup when participants are responding to your survey
(suggest hourly if high number of responses are expected - over 100).
Since EduPros facilitates a method to backup and restore your own account, the
liability of your data is in your own hands. Please take care and backup
regularly. No matter how hard EduPros tries to protect the integrity of your
data, events can happen that challenge that integrity. Your backup files define
the reliability of the system.
Indemnity
You agree to indemnify and hold EduPros Inc. and its affiliates, officers,
agents, subsidiaries, partners, and employees, harmless from any claim or
demand, including attorney fees, made by any third party to or arising out of
content of surveys, content of emails, email lists used, transmittals, or any
part of service made available through EduPros, your use of the service, your
connection to the service, your violation of the Terms of Service, or your
violation of any rights of another.
Liability Disclaimer
YOU EXPRESSLY UNDERSTAND AND AGREE TO THE FOLLOWING:
1. YOU TAKE THE SOLE RISK IN THE USE OF THIS SERVICE. THIS SERVICE IS PROVIDED
ON AN "AS IS" AND "AS AVAILABLE" BASIS. EDUPROS EXPRESSLY DISCLAIMS ALL
WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
2. EDUPROS MAKES NO WARRANTEE OR GUARANTEE THAT THE SERVICE WILL MEET YOUR
REQUIREMENTS, SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE,
NUMBER OF RESPONSES, THE RESULTS FROM THIS SERVICE WILL BE ACCURATE OR RELIABLE
BEYOND THE INTEGRITY OF THE SURVEY USED, THE QUALITY OF ANY PRODUCTS, SERVICES,
INFORMATION, OR OTHER MATERIALS PURCHASED TO WORK WITH THIS PROGRAM,
COMPATIBILITY WITH OUTSIDE PROGRAMS, TO MEET YOUR EXPECTATIONS, AND ERRORS IN
THE SOFTWARE WILL BE CORRECTED.
3. EDUPROS IS NOT A CERTIFIED COLLEGE OR DEGREE PROGRAM THEREFORE DO NOT RELY
ON ANY ADVICE CONCERNING YOUR RESEARCH OR USE OF THIS SERVICE INCLUDING BUT NOT
LIMITED TO: HELP MENUS, SURVEY DESIGN, SURVEY USE, QUESTIONS ON A SURVEY,
METHODOLOGY, DATA COLLECTION, OR OTHER RESEARCH SPECIFIC ISSUES. ASK YOUR
COLLEGE OR UNIVERSITY FOR ADVICE.
4. NO ORAL OR WRITTEN ADVICE OR INFORMATION OBTAINED BY YOU FROM EDUPROS OR ANY
AFFILIATE OF EDUPROS OR ANY SERVICE FROM EDUPROS SHALL CREATE ANY WARRANTY NOT
DIRECTLY STATED IN THE TERMS OF SERVICE.
5. YOU EXPRESSLY UNDERSTAND THAT EDUPROS IS NOT LIABLE TO YOU FOR ANY INDIRECT,
DIRECT, INCIDENTAL, OR SPECIFIC DAMAGES; INCLUDING BUT NOT LIMITED TO LOSS OF
RESEARCH, DATA, PROFIT, ACCOUNT INFORMATION, RESEARCH RESULTS, OR ANY OTHER
FORM OF DATA OBTAINED OR ENTERED THROUGH THE SERVICE, USE OR INABILITY TO USE
THE SERVICE, UNAUTHORIZED ACCESS, EDUPROS ACCESS TO YOUR ACCOUNT, DATA,
RESEARCH AND OTHER SERVICE RELATED DATA.
6. THROUGH MAINTENANCE, ACCOUNT AUDITS OR DEVELOPMENT ON THE EDUPROS RESEARCH
CADDY PROGRAM, EDUPROS OFFICERS, STAFF, AND EMPLOYEES HAVE ACCESS TO YOUR
INDIVIDUAL DATA. ANY INFORMATION DISCOVERED MAY BE USED AGAINST YOU IN THE
EVENT OF VIOLATIONS TO THE TERMS OF SERVICE.
7. EDUPROS RETAINS THE RIGHT TO CONTACT YOU AS A CUSTOMER THROUGH EMAIL, PHONE,
OR DIRECT MAIL IF NEEDED. YOUR INFORMATION WILL NOT PASS TO ANY AFFILIATE
OUTSIDE OF EDUPROS INC.
Customer Support
All claims to

will be answered in due time. Most emails are answered within
24 hours, but dependent on volume of emails, this time may vary. Please try the
online help, it is designed to grow. Each time a key word is searched and not
found, it is added to the help database. Therefore, future searches will
include results if relevant to the program.
Termination and Restrictions for Usage
EduPros reserves the right to discontinue service to any account holder. If
your account is terminated for any reason, lack of reason, or no written
notice, upon termination of your account you will have no right to continue to
use the service or access any stored information on the service. You understand
that when an account is terminated the data in that account may be permanently
deleted by EduPros. If an account is not terminated, but expires through the
natural time allotted by the subscription, your account information will be
held for no more than 30 days awaiting renewal of your account. If it has been
over 30 days, the restore process will not reload a previously deleted account.
Even with the backup file, the account can not be restored.
